Contract of Sale

Terms & Conditions

These terms and conditions apply to all users of the oncidiumjewellery.com website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. By placing an order with Oncidium Jewellery (“us”, “we”, “our”) you agree to accept these terms and conditions.

Please note, these terms and conditions can change at any time, and it is up to you to check these terms and conditions regularly before ordering products. Only the most recent version of these terms and conditions will be considered valid. If you do not agree with the terms and conditions set out below, you should not continue to use or access these websites.

Our store is hosted on Wix.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

If you have any queries relating to our terms and conditions, please contact us before placing an order.

 

Contract Of Sale 

  • After placing an order you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an email that confirms that the product has been dispatched (the Dispatch Information). The contract between us will only be formed when we send you the Dispatch Confirmation. This confirmation email will be sent to the email address given in your order form and will detail products ordered, payment method, cost (including VAT and P&P) and usual delivery times.

  • You must check all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect. Any changes or additional alternations of your bespoke, personalised and/or engraved order will need to be informed by email.

  • Our acceptance of your order takes place on the dispatch to you of the products ordered unless we notify you that we do not accept your order, or you have cancelled your order in accordance with the clause 'Order Cancellation' below. Our acceptance of your order brings into existence a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.

  • Your orders will be processed as soon as your full payment is received by us.

  • All items are subject to availability. If we are unable to fulfil an order, any monies paid will be refunded. We are not liable for compensation or damages if an item is unavailable.

  • All jewellery remains the property of Oncidium Jewellery until it is paid for in its entirety.

 

  • All prices listed on oncidiumjewellery.com are correct at the time of entering the information; however, we reserve the right to change prices of any product at any time. All prices include sales tax.

 

Bespoke, Personalised And Engraving Products

  • Bespoke Products include products that have been made to measure, personalised or customised products that have been ordered, this includes resized rings and any specifically engraved items.

  • Bespoke, Personalised and Engraving Products are not refundable nor exchangeable.

  • If you order a resized ring, it is possible that the price may vary or that we may be unable to supply it. In respect of the above mentioned products, you will not have the right to cancel – please see 1.4 below.

  • All of our bespoke, personalised, customised and engraved products are made to your specifications and as a result they are not subject to the Consumer Protection (Distance Selling) Regulations 2000. You will not have any right to cancel unless these Products are defective as a result of our fault or they do not meet your specifications.

  • The provisions of this clause 1.1 and 1.2 do not affect your statutory rights.

  • You can request for additional alternations twice before the Bespoke and Personalised Products manufacturing process begins. This does not apply to Engraving nor Standard Products.

 

Pricing, Delivery And Discount Codes

  1. The prices payable for goods that you order are as set out in our website.

1.1. All of our prices are in UK Pounds. You will be billed in UK Pounds and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card.
 

  1. You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website.

  2. Promotional discount codes: We may from time to time offer promotional discount codes (either directly or via third parties) which may apply in respect of any, or certain specified, purchases made though this Website. Such codes may only be applied to purchases of full-price items and cannot be used in conjunction with any other offer or discounts.

  3. View Delivery Times & Costs

  4. Please note that prices in all printed publications are correct at the time of publication and we reserve the right to amend these without prior notification.

 

Order Cancellation

Unless you cancel your order within 5 working days after full payment has been made, acceptance of your order and completion of the contract between you and Oncidium Jewellery will be completed when the goods have been dispatched.

 

To cancel your contract you must notify us of your decision by email info@oncidiumjewellery.com here using the subject heading ‘Cancellation’ and supplying your order number and address. Any returns after the 5 day period stated above will be at the discretion of Oncidium Jewellery.

 

Cancellation By Us

  1. We reserve the right to cancel the contract between you and us if:

1.1. We have insufficient stock to deliver the goods you have ordered;
1.2. we do not deliver to your area; or
1.3. one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

  1. If we do cancel your contract we will notify you by email or by telephone, and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

 

Delivery Of Goods To You

  1. We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used.

  2. All orders within the UK are delivered using Royal Mail Special Delivery or an alternative carrier during Royal Mail industrial action.

  3. You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

  4. We make no promise that materials on our website are appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

  5. If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs.

Liability

  1. If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email of the problem within 7 working days of the delivery of the goods in question.

  2. If you do not receive general goods (excluding: bespoke and personalised goods) ordered by you within 7 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by email or telephone at our contact address of the problem within 7 days of the date on which you ordered the goods. If you notify us of a problem under this condition, our only obligation will be, at your option either:

2.1. to make good any shortage or non-delivery; or
2.2. to replace any goods that are damaged or defective; or
2.3. to refund to you the amount paid by you for the goods in question in whatever way we choose.

  1. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the clause mentioned in 2.3. above.

  2. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

  3. Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

  4. We cannot be held responsible for any delays once the goods have left us and are in possession of the courier or Royal Mail.

 

Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by email to our contact address at info@oncidiumjewellery.com and all notices from us to you will be displayed on our website from time to time.

 

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

Privacy

You acknowledge and agree to be bound by the terms of our Privacy Policy.

 

Third Party

  1. Third Party Rights: Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

  2. Third Party links: We may include hyperlinks on this Site to other websites or resources operated by parties other than Oncidium Jewellery, including advertisers. Oncidium Jewellery has not reviewed all of the sites linked to its Web Site and is not responsible for the content or accuracy of any off-site pages nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offense caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.

 

Governing Law

Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

 

Entire Agreement

  1. These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

  2. We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors.

 

Trade Marks

Oncidium Jewellery is the operator of www.oncidiumjewellery.com. All trademarks, product names and company names or logos sited herein are the property of their respective owners. No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.

 

Events Beyond Our Control

We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

Our Rights

We reserve the right to change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

 

Promotions

Oncidium Jewellery occasionally releases promotion codes. To be the first to know about any offers or sale events, sign up to our newsletter.

To use a promotion code, please enter the code in the box provided on the basket page, click 'Redeem' and the discount will be applied to your shopping basket.

Terms & Conditions

  1. Unless advised that your offer will automatically be applied to your basket, you must enter the promotion code during the checkout process when placing your order online, otherwise the discount will not be applied to your order.

  2. Promotion codes are only valid on full price items and exclude sale items, gift wrap, gift cards and special orders.

  3. Only one code can be used per transaction.

  4. All offers are subject to stock availability and are subject to change at any time.

  5. Codes are non-transferrable and no cash alternative is available.

  6. Any promotion code offered on the website is valid only for use against a purchase made via the website, unless otherwise stated.

  7. If returning an item from an order purchased with a promotion code applied, then the same discount will be applied to each item of your order that you return. Further, any free promotional gift given with an order must also be returned if you are returning the item(s) to which the gift related.

 

Special Offers & Free Delivery

  • All special offers available for purchase without the use of a promotional/discount code are limited whilst stocks last.

  • Free Delivery offers apply to standard delivery only and does not include express/next day delivery options. Such offers may be extended or removed at any time.

 

Loyalty Program

Oncidium Jewellery runs an invite-only loyalty program and a community called Elite Club. Members could:

  • receive gifts

  • priority online access to new arrivals and events

  • exclusive digital promotions

Members can enter their unique codes at the checkout, show their card in stores, or quote over the phone. Promotions are non-transferable, for personal use only and not valid in conjunction with any other offer. Promotions aren't valid on giftwrap, giftcards, engraving, sale items or bracelet stacks. Oncidium Jewellery may offer further benefits, cancel, withdraw or alter the programme, including these T&Cs or any individual account, at any time at their discretion.

Gift Cards

Oncidium Jewellery Gift Cards are available to buy online, with denominations between £20 and £1000.

To redeem a Gift Card online, simply enter the Gift Card code in the voucher code box at the checkout and click on 'Redeem'.

Terms & Conditions

  1. Gift cards can only be redeemed online at OncidiumJewellery.com;

  2. If a product is returned to us that has been purchased using a gift card, the value will be refunded onto the original gift card or a new one will be issued.

  3. Gift Cards cannot be returned or exchanged for cash alternative.

  4. Gift Cards redeemed online at OncidiumJewellery.com must be redeemed in full in one transaction. If you would like to part-redeem the value of a Gift Card then please contact us by info@oncidiumjewellery.com

  5. Promotional codes cannot be used in conjunction with gift cards.

  6. Promotional codes cannot be used when purchasing a gift card.

  7. Gift Cards expire two years from date of purchase.

Delivery Times And Shipping Costs

 

Standard delivery service and shipping costs by either Royal Mail, DHL or DPD:

  • UK - Free signature post; 3 -5 Business working days for delivery

  • EU - £13 per parcel, or Free *when purchase items over £100 or above; 5 - 7 Business working days for delivery

  • International - £15 per parcel, or Free *when purchase items over £100 or above; 7 - 10 Business working days for delivery

 

When the orders are above £200, special / next day delivery shipping costs in the UK, EU and international will be free of charge.

 

Please note: EU customers are responsible for all custom charges after Brexit.

 

Further Information

Orders may be subject to security checks, which can cause delays in the processing of orders. We may need to contact you to carry out these security checks – if we are unable to reach you using the contact details provided it will delay the despatch of your order.

Parcels will need to be signed for in person. Please ensure the delivery address is an address where you will be at the time of delivery (home or work). If someone is not present at the time of delivery, our courier company will leave a calling card and you will be able to reschedule your delivery for a more convenient time.

Parcels with a business address chosen will be delivered to the designated delivery place at the chosen business address, not directly to the recipient.

Return And Refund Policies 

 

Made To Order

With the exception of some of our recycled silver jewellery, most pieces of Oncidium Jewellery are made to order for each customer. The time taken in our manufacturing process means you will receive a high quality, luxury product that ensures longevity. We want you to love your jewellery purchase and thank you in advance for your patience.

 

Because all our products are handmade in the UK in limited batches, we don’t always hold stock of every item. If the jewellery piece you would like to order is not currently in stock, you will see a note at the side of the product that it is ‘Made to Order’. You will be informed by email if this is the case – and orders can take from 8 up to 12 weeks to complete depending on the complexity of your chosen designs and specifications. We will update you of the expected delivery time with your confirmation email. If you have any queries, or are in an exceptional hurry please email the team on info@oncidiumjewellery.com and we will do our best to help you.

Any items that are listed as “in stock” on the website will be delivered to you within 7 working days.

 

Returns

We hope you will be absolutely delighted with your new jewellery. All bespoke, personalised, engraved jewellery items and earrings are not available for return or refund.

 

If for any reason you are not satisfied with your purchase with your standard jewellery order, Oncidium Jewellery is happy to offer an exchange or credit note within 30 days of purchase. We can refund a sale made through this website if it is returned unworn, in perfect condition, and in its original packaging within 14 days of your receipt of the order.

 

Should you find a fault with your item, please contact us within 24 hours of receiving your order. Once you have notified us of your faulty item, we will confirm your return in writing. You should then post the item back to us by post.

 

Please note: you will be responsible for the item(s) until they reach us as we cannot be held responsible for items that become lost or damaged during your return postage to us, therefore we suggest you use a secure delivery service which requires a signature for proof of receipt.

 

Processing Your Refund

Upon receipt of the items being returned the Paypal account, credit or debit card originally used for the purchase will be credited with the cost of the goods minus the delivery charges (exceptions may apply).

 

We will process your refund within 48 hours of receipt of goods. Your credit card company may take 5-7 working days to credit your account.

 

Sale Returns

All orders placed during our sale may be returned and are subject to our standard returns policy as seen above.

 

Receiving A Refund

Refunds will be made within 30 days of the date of cancellation notice. The cost of any undamaged and unworn products, correctly returned will be credited to the original purchaser's credit card, including sales taxes for all EU country shipments and any shipping charges. As previously stated, international customs duties and sales taxes are non-refundable for shipments outside the European Community (EU).

 

Earrings, Engraving, Personalised & Bespoke Orders

Please note that earrings, engraved products, personalised orders, bespoke items, special orders and items that we do not currently carry in stock, cannot be exchanged or returned under any circumstances.

Returning Faulty Items

Faulty items will only be accepted if the goods are delivered to the customer damaged, or if there is a subsequent manufacturing fault within a period of 12 months after delivery. All items returned as faulty will be inspected, and any item displaying damage deemed to be a result of fair wear and tear will not be accepted as faulty.

 

Note: your statutory rights are not affected. Where possible, items may be repaired on request but only where such items are deemed faulty and repairable. Repairs do not come with a guarantee. It may be possible for us to repair items which have suffered wear and tear. There will be a charge for this service, which is to cover the cost of shipping and any other costs incurred.
